General conditions of use

General Provisions

The Parties shall comply with the laws of the Republic of Estonia and other legal acts and conditions of use for regulating relations between each other.

Parties

Seller: M&V Trade OÜ (Registry code 11428830, Priisle Tee 10, Tallinn, 13914 Harjumaa, Estonia, ph. +372 6805 647, [email protected]).

Buyer: A natural or legal person who, before performing and using the transaction, confirms that he has read the terms and agrees and undertakes to comply with them.

Goods prices, availability, and product information

The product photos displayed on the item’s product information page are illustrative and may vary from the actual appearance of the goods.

The prices of all goods sold in the e-store are in euros and include VAT of the Republic of Estonia at the time of purchase and sale.

The prices are valid starting from placing an order until the expiry of the payment term of the order (7 days after placing the order).

If the order was submitted before the change in sales terms or prices, the terms and conditions in force at the time of placing the order will be adjusted to the legal relationships between the buyer and M&V Trade OÜ.

The seller has the right to make changes to the E-store services at any time without the obligation of notifying the service user thereof in writing.

The seller of the goods has the right to back out from the order in the event of a technical error, due to which the price of the product in the e-shop is erroneous.

If, after payment of the goods by the purchaser, it appears that the goods requested by the purchaser have sold out in the seller’s warehouse, the purchaser is entitled to receive the money back for the missing product.

We send goods to the following countries: Estonia

To receive the goods, the buyer has the following options:

  • Itella Smartpost Parcel Machine
  • Omniva parcel machine
  • DPD Pickup Point
  • You can also pick up your order at Priisle Tee 10, Tallinn, on working days from 9:00-16:00. At the M&V Trade OÜ office you can pay with cash and bank cards or mobile payments.

Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method. The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when ordering.

Depending on the mode of delivery chosen, you will normally receive the goods within 2-7 business days. In the event that a parcel is delayed for any reason, M&V Trade OÜ Customer Support will agree to another suitable delivery time with the purchaser.

Checkout, processing of purchase and sale

To subscribe, the buyer has the option of creating a user account https://mvtrade.ee/ or placing the order without creating a user account. Creating a user account allows the purchaser to get benefits from our customer program, best offers, and promotions.

After selecting an item, you must add the product/products to the shopping cart.

You can see the shopping cart by pressing the “Shopping cart” button on the home page header and moving to the shopping cart page.

All products added to it will be visible in the basket, and the desired amount (pieces) and the price will be displayed for each product, as well as the total cost of the basket.

To start the check out click on the “checkout purchase” button, which will take you to the checkout page.

To complete the order, please fill in the information required to deliver the parcel. If you want to send the parcel to someone else – for example, as a gift – please request the delivery to another address and enter the package receiver’s details.

Upon confirmation of the order, an order form will be prepared which can be paid instantly via bank link or bank transfer. A copy of the approved order will also be sent to your e-mail address in case you want to pay for the order later.

The goods are picked up in the seller’s warehouse only after payment for the goods.

Payment Methods

In the M&V Trade OÜ online store, we offer the following options for paying for your purchase:

Bank Links

  • Estonian bank links: Swedbank, SEB Bank, Luminor Bank, LHV Bank, Coop Bank.
  • Visa/Mastercard card payments

NB! When paying with a bank link, be sure to click the “Back to merchant” button on the bank’s page.

Payments are mediated by Montonio Finance OÜ. Payment takes place outside the Online Store in a secure environment – when paying with a bank link in the secure environment of the respective bank and when paying with a credit card in the secure environment of Montonio Finance OÜ.

The seller does not have access to the customer’s bank and credit card details. The Agreement enters into force upon receipt of the amount due to the current account of the Online Store.

The owner of the online store is the chief processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

Bank Transfer
When you confirm your order, an order form appears. A copy of the order arrives instantly to your e-mail address so that you can print it out and pay by bank transfer in the Internet bank or at a branch at your convenience. If you pay by bank transfer, be sure to check the order number on the order.

Delivery and Dispatch procedure

After the entry into force of the sales contract (payment by the client), M&V Trade OÜ will transfer the goods to our logistics partners for delivery.

If a parcel is delayed for any reason, M&V Trade OÜ Customer Support will agree to another suitable delivery time with the purchaser.

Pre-indicated delivery deadlines are valid from the moment the order is paid.

For deliveries without delay, please be careful when entering the delivery details when completing the order.

Shipments that have been injured during transport where products, but not product packaging, have been damaged shall be substituted for the customer. We offer compensation for the cost of the damaged goods if their replacement is impossible.

M&V Trade OÜ is not responsible for any delay in delivery of the goods if the goods have been transferred to the logistics partners by a timely delivery date or if the delivery delays are due to circumstances that M&V Trade OÜ could not influence or anticipate.

Order Cancellation

If the delay in delivery of the goods to the destination or any other misunderstanding is caused by the inaccuracy or incorrectness of the data submitted by the purchaser in placing the order, the seller shall not be liable for such delay and the purchaser shall not have the right to withdraw from the purchase and sale contract.

If the purchaser is not present at the pre-agreed time with the supplier of the goods, if any other circumstance dependent on the purchaser results in the delay of the delivery, or if the goods must be delivered multiple times, the seller has the right to submit a separate invoice for transport.

The buyer has the right to back out from the purchase and sale contract in a situation where a purchase or sale has been concluded between the buyer and the seller but where the delivery of the goods to the destination specified by the purchaser takes longer than the delivery term specified in the terms for reasons resulting from the seller’s activity or non-activity.

The buyer has the right to back out from such a contract within 1 working day from the date of becoming aware of the seller’s nondelivery of the goods and the reasons thereof, giving the seller a withdrawal application in a format which can be reproduced in writing.

Submission of claims, return of goods

Complaints related to goods or services purchased from the E-store should be forwarded to [email protected]. If you are not satisfied with the quality of the delivered goods and want to return or replace them, please notify us no later than 24 hours after delivery by e-mail [email protected] or by phone +372 6805 647.

The seller shall not be liable for defects in the goods if:

  • Complaints on groceries are submitted later than 24 hours from the moment of receipt of the goods;
  • If the goods have not been stored by the information given on the packaging;
  • The “best before” date has passed while in the customer’s possession.

The 14-day return does not apply to products which are perishable or which age quickly, as well as to sealed products which are not eligible for return for health or hygiene reasons and if the packages have been opened after delivery.

Upon returning the goods, the purchased product (products) must be returned immediately, but not later than within 14 days. You are required to complete the withdrawal application here.

Returned products must be unused and intact in their original packaging. A product shall not be considered to have been used if it has been examined in a manner that is necessary to verify the nature, characteristics, and functioning of the product in such a way as is permitted to test the product in the physical store. If the products have been used for purposes other than those necessary to ascertain the nature, characteristics, and functioning of the goods, or if they have any signs of use or wear and tear. If you have opened the product packaging, we will only replace products if they are damaged or defective. The return of goods is effected at the expense of the client and, in this case, the initial transport fee is not reimbursed (unless the returned goods do not correspond to the order).

Upon receipt of the returned goods, the online store shall return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer on the basis of the contract.

The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided proof that he has returned the item, whichever is earlier.

By the Law on obligations, the right of withdrawal does not apply to products which, by their nature, cannot be returned, including underwear, open-label cosmetics and perfumes, chilled and frozen products, perishable (i.e. with “expire…”) products, periodicals (newspapers, magazines, etc.), and other products according to § 53 section 4.

The right of withdrawal does not apply if the buyer is a legal person.

Privacy Terms

M&V Trade OÜ is the chief processor of personal data. All personal data of the client that has become known in the online shop of M&V Trade OÜ and in the course of making purchases are treated as confidential information. Encrypted data communication channels with the banks ensure the security of the personal data and bank details of the buyer.

Personal information entered by the purchaser (including name, telephone number, address, e-mail address) is used to process the order and send the goods to the purchaser.

  • The e-shop forwards the personal data necessary for making payments to the authorized processor Montonio Finance OÜ.
  • The e-shop transmits personal data to the companies providing the transport service in order to deliver the goods. The e-store transfers personal data to companies providing transport services to deliver goods.

M&V Trade OÜ applies all precautions (including administrative, technical, and physical measures) to protect the customer’s personal data. Only authorized persons have access to modify and process the data. Customer personal data is processed by M&V Trade OÜ.

The purchaser will receive newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed his/her wish to do so in the e-shop.

The buyer can at any time opt-out of the offers and newsletters by sending an e-mail or following the instructions in the e-mail.

Responsibility

In the event that M&V Trade OÜ violates its obligations, the customer has the right to demand performance of the obligation; refuse to perform the obligation due; demand compensation for damages, reduction of price, or delay in execution of financial obligation; or withdraw from the contract.

The seller is not liable for damages caused by untargeted use of the ordered goods.

All complaints shall be reviewed and the Consumer shall be contacted at the first opportunity, but no later than within 14 days following the receipt of the complaint.

If M&V Trade OÜ has refused to resolve the client’s complaint or the client does not agree with the solution offered by M&V Trade OÜ and finds that its rights or interests have been violated, the client may bring a complaint with the Consumer Complaints Committee through the Consumer Protection Board or the court. The Consumer shall have the right to submit the complaint himself or through a representative. The Consumer Protection Committee details are provided on the Consumer Protection Board website, in order to address the challenges arising in the EU Member States of consulting the EU consumer centres.
